With the decision published in the Official Gazette dated 01.08.2023, the Constitutional Court issued a comprehensive violation decision on the institution of “Deferral of the Announcement of the Verdict” regulated under Article 231 of the Criminal Procedure Code (CPC) No. 5271.
In the examination made by the Constitutional Court; the requirement to waive the legal remedy in case of application to the “Deferral of the Announcement of the Verdict” institution, the moment when the defendant submits the statement of acceptance of the “Deferral of the Announcement of the Verdict”, the function of this institution and the state of impunity were examined and as a result of the evaluation made, it was decided to cancel paragraphs 5, 6, 7, 8, 9, 10, 11, 12, 13, 14 of Article 231 of the Criminal Procedure Code.
The annulment decision will enter into force on 01.08.2024, 1 year after its publication in the Official Gazette.
